TOLMENA measures a web page against a published rule set and tells you what it found. It is a measurement, not a certificate. No automated tool can establish that a site meets the law, and we never claim ours does.
1 · Who these terms are between
These terms govern your use of tolmena.com and the scanning service at api.tolmena.com (together, "the service"), operated by Cemil Ceyhan, sole proprietor, trading as TOLMENA ("we", "us"). Using the service means you accept them. If you do not accept them, do not use it.
2 · What the service does
You submit a public web address. We open the page in a real browser, run a published set of automated checks against it, apply four stress tests (text enlargement, text spacing, narrow viewport, translation), filter out findings our rule set marks as unreliable, and return a report.
The rule set is derived from WCAG 2.2 Level AA, which EN 301 549 adopts and which the European Accessibility Act (Directive 2019/882) relies on. The version in force is shown on every report.
3 · What you are responsible for
- You may only submit an address you are entitled to have scanned: one you own, one you operate, or one whose owner has given you permission.
- You must not use the service to disrupt, overload or probe a site, or to circumvent any access control, rate limit or protective measure.
- You must not resell, relabel or present our reports as the output of a different tool or of your own audit, without saying that TOLMENA produced them.
- You must not attempt to scan private, internal or non-public addresses. The service refuses them, and trying to get around that refusal ends your access.
You must be able to enter into a binding contract under the law that applies to you, and you must be at least 18 years old. The service is intended for businesses and for the people who build and maintain their websites.
We may refuse or stop any scan, and may limit how many scans one network can run per day, without giving a reason.
4 · What an automated scan cannot tell you
A clean report does not mean your site is accessible, and it does not mean your site is compliant with any law.
Automated checking reaches a minority of accessibility requirements. The rest need a person. Specifically, our scan cannot judge:
- whether alternative text actually describes the image it belongs to;
- whether reading and focus order make sense to someone using a screen reader or a keyboard;
- whether a video's captions are correct, or whether audio description is adequate;
- whether an error message helps a person recover, or merely exists;
- whether a custom component behaves the way its ARIA role promises;
- anything behind a login, a payment step or a flow the scan does not reach.
Every report we issue names these limits on its own face. We publish what the scan cannot see because a report that hides its own blind spots is worse than no report.
5 · No legal advice, no warranty of compliance
Nothing on this site or in a report is legal advice. We do not certify conformity, we do not issue accessibility statements on your behalf, and we do not represent you before any authority. Whether your organisation falls under the European Accessibility Act, a national implementing law, or any other obligation is a question for your own legal advisers.
The service is provided as is. We do not warrant that it will be available without interruption, that a scan will succeed on any particular site, or that it will find every defect present.
6 · Liability
We are liable without limit for damage caused intentionally or by gross negligence, for injury to life, body or health, and wherever liability cannot be excluded by mandatory law. Otherwise, and in particular for the free tier, our liability is limited to foreseeable damage typical of this kind of contract, and we are not liable for lost profit, lost business or indirect loss.
We are not liable for what you do with a report, for decisions you take on the strength of it, or for the content of any site you scan.
Where our liability can be limited, it is limited to the amount you paid us for the service in the twelve months before the event. The scan described on this site is free of charge, so that amount is currently zero. This limit does not apply to the matters named in the paragraph above, which no contract term can exclude.
7 · If a scan you ordered causes us a claim
Section 3 asks you to submit only addresses you are entitled to have scanned. If you submit one you were not entitled to, and the owner or operator of that site brings a claim, a complaint or a demand against us because of it, you will cover our reasonable costs of answering it, including legal costs.
This does not apply where the claim arises from our own fault, and it does not apply to anything we did beyond carrying out the scan you asked for. We will tell you promptly about any such claim, will not settle it without talking to you first, and will let you take over the defence if you wish.
8 · Things outside anyone's control
We are not responsible for failure or delay caused by something outside our reasonable control: network or hosting outages, failures at the site being scanned, power cuts, strikes, government action, or an attack on our infrastructure. If such a condition lasts more than thirty days, either of us may end the use of the service without liability.
9 · Price and availability
The scan described on this site is currently offered free of charge. No payment is taken and no payment details are collected. We may introduce paid plans later; any such plan will be described separately before you can buy it, and these terms will be updated accordingly.
10 · Intellectual property
The site, the rule set, the report layout and the TOLMENA name are ours. The report we generate about your site is yours to use, publish, and share — we only ask that it keeps the line naming the tool and the rule set version, so a reader can tell where the numbers came from.
11 · Changes and termination
We may change these terms. The version number and date at the top of this page change with them, and material changes are announced on the site before they take effect. We may suspend or end access for anyone who breaches section 3.
12 · Governing law
These terms are governed by the law of Türkiye, without prejudice to any mandatory consumer protection in your country of residence. The place of jurisdiction is Tekirdağ, to the extent the law permits a choice.
You may not transfer your rights or obligations under these terms without our written consent. We may transfer ours if we sell or reorganise the business, and will tell you if that happens.
If any provision is or becomes invalid, the rest stays in force.
